These Terms of Service ("Terms") govern the use of the Gymix software application and associated services ("App", "Gymix", "Services") provided by WD Ambitions ("us", "we", or "our").

Please carefully read these Terms before accessing or using any of our services.

Your access to and use of the Gymix Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

User Content

Gymix enables users to post, link, store, share, and otherwise make available certain information, text, or other material ("Content"). Users are solely responsible for the Content they post to the Service, including its legality, reliability, and appropriateness. By posting Content to the Service, users grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, modify, reproduce, distribute, and display such Content on and through the Service. Users retain any and all rights to their Content.

Gymix Account

Users must provide accurate, complete, and current information when creating an account with Gymix. Users are responsible for maintaining the security of their account and password. They agree not to disclose their password to any third party and to notify us immediately of any unauthorized use of their account. Users may not use usernames that violate any third-party rights or are offensive, vulgar, or obscene.

Intellectual property

The Gymix Service, including its original content, features, and functionality, is owned by WD Ambitions and is protected by copyright, trademark, and other laws of the Netherlands, the European Union, the United Kingdom, the United States, and other countries. Users may not use our trademarks without our prior written consent.

Links to other websites

The Gymix Service may contain links to third-party websites or services that are not owned or controlled by WD Ambitions. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Users acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Termination

We reserve the right to terminate or suspend a user's account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if the user breaches the Terms. Upon termination, a user's right to use the Service will cease immediately.

Limitation Of Liability

In no event shall WD Ambitions, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in any way connected with the use of the Gymix Service.

Your Health

The use of Gymix and all related services is at the user's own risk. Gymix does not provide medical advice. Users with pre-existing medical conditions should seek medical advice before using the service. Users expressly agree that any exercise activity performed or tracked using Gymix carries inherent risks, and Gymix shall not be liable for any damages resulting from such activities.

Disclaimer

The Gymix Service is provided on an "AS IS" and "AS AVAILABLE" basis. WD Ambitions makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Gymix Service after any such changes shall constitute your consent to such changes.
